A Connecticut judge has identified what appears to be the first attempt by a US plaintiff to hide AI-readable instructions in court filings. The instructions were invisible to human readers but legible to document-reading software, and were designed to steer any AI system toward the plaintiff's arguments.
Judge Walter Spader Jr. said the hidden text had no effect on the ruling, but warned that the tactic sets a dangerous precedent. As AI tools become more common in courts, judges may see more such attempts.
