In Apparent First, Plaintiff Hides AI Prompts in Court Filing to Sway Case

A Connecticut judge said a man suing a healthcare provider over access to records attempted to hide instructions in court filings that were invisible to human readers but readable by AI software, in what appears to be the first such attempt by a US plaintiff. The hidden text told any AI reviewing the document to support the plaintiff's arguments, disregard the court's prior denials, and direct the outcome he wanted.

Judge Walter Spader Jr. said the tactic had no impact on the case and was decided on the merits, but warned it set a "dangerous" precedent. As AI tools become more common in courts, he predicted this tactic would likely appear again.
