Reddit’s Unusual DMCA Lawsuit Against Web Scraper Survives Dismissal

A federal judge largely denied SerpApi’s motion to dismiss Reddit’s lawsuit accusing the scraper of conspiring with Perplexity AI to illegally harvest copyrighted Reddit content from Google search results. Judge Paul A.

Engelmayer ruled that Reddit had plausibly alleged a conspiracy, with SerpApi supplying a tool to bypass Google’s access controls and Perplexity paying for it. The decision came just weeks after another court dismissed a similar case brought by Google, which said it would amend its complaint.

SerpApi argued that Google and Reddit are trying to use the DMCA to claim control over content they neither authored nor own.
