Reddit’s Unusual DMCA Lawsuit Against Web Scraper Survives Dismissal

A federal judge largely denied SerpApi’s motion to dismiss Reddit’s lawsuit, which accuses the web scraper of conspiring with Perplexity AI to illegally scrape copyrighted Reddit content from Google search results. Judge Paul A.

Engelmayer ruled that Reddit had plausibly alleged a conspiracy, with SerpApi providing a way to bypass Google’s access controls and Perplexity paying for it. The ruling comes less than two weeks after a different court dismissed a similar case brought by Google, which had failed to show rights holders authorized the search engine to block scraping.

SerpApi argued that Google and Reddit are misusing the DMCA to control content they did not create or own.
