A Connecticut judge identified what appears to be the first US case in which a plaintiff hid text in court filings that only AI systems could read, attempting to influence the court's automated review. The hidden instructions urged any AI reading the document to align its outputs with the plaintiff's arguments, disregard prior court denials, and support the desired remediation.
Judge Walter Spader Jr. said the tactic had no effect on the ruling, but called it a dangerous precedent as AI tools become more common in courts.
